May 21 & 22nd, 2016, 1001 Panoramic Way owner Sandy Boyd defies Oakland hearing officer's April 13th, 2016 ruling denying his appeal to the August 26th, 2015 NOTICE TO ABATE. The ruling "assessed and hereby ordered (Boyd) to pay a total fine of $103,529.00" for failing to abate the nuisance within 30 days of the notice as well as continuing to advertise the property as a venue for group events. Citing "The defendants have violated Oakland Municipal Code 17.13 and 1.08", "Defendant's property..is in a 'hillside residential zone,' and is not permitted by Oakland Municipal Code for any commercial activities.", "The weddings, etc. which the defendant David Boyd has been advertising and conducting are prohibited by OMC 17.13.030."
The property with mailing address 1001 Panoramic Way, Berkeley, CA, DBA Skyfall, is physically located in the City of Oakland in an area zoned RH-1 (residential) where commercial activities, including weddings for hire are NOT PERMITTED.
On April 15th, 2014, the City of Oakland issued a NOTICE OF VIOLATION stating "Operation of a Group Assembly Commercial Activity, catering and or holding various events at this residentially zoned location (zoned RH-1) is not allowed or conditionally allowed." with a required action of "Cease this Activity". The owner of the property filed an appeal and a hearing was held on November 18, 2014. The appeal was denied, citing "..all commercial activities are prohibited in the RH-1 zone." and "Therefore the Notice of Violation is sustained and the Appeal is denied". See the entire decision here.
On September 12th, 2015, the Panoramic Hill Association sent a letter to the City of Oakland voicing their opposition to the commercial use of 1001 Panoramic Way "for large events such as weddings, parties and meetings" citing "Our neighborhood is among the most dangerous areas for potential loss of life from wildfire in California." On October 16th, 2015, the Panoramic Hill Association sent another letter to the City of Oakland stating "any commercial use of 1001 Panoramic Way...imposes unacceptable new hazards to residents of Berkeley and Oakland; and that commercial use is incompatible due to the fundamental limitations intrinsic to this specific location, which are beyond mitigation." Therefore the PHA has "determined that engaging in mediation regarding commercial use of this property is inappropriate" and once again has asked the "City of Oakland to enforce the Cease and Desist Order that it has issued."
